§ 1. Service provider

  1. The VELMOIS website at velmois.com (the "Website") is run by MOISS sp. z o.o., registered office in Wrocław, address: ul. Stanisława Leszczyńskiego 4/25, 50-078 Wrocław, entered in the register of entrepreneurs of the National Court Register by Sąd Rejonowy dla Wrocławia-Fabrycznej we Wrocławiu, VI Wydział Gospodarczy KRS under KRS number 0001254975, NIP (tax id) 8971976015, REGON 545269929, share capital PLN 5,000.00 (the "Provider", "we").

§ 2. What these Terms cover

  1. These Terms set out the rules for using the Website and for the services we provide electronically within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  2. In these Terms:
    1. a User is anyone who uses the Website;
    2. a Consumer is a natural person using the Website for purposes not directly related to their business or profession (Article 22¹ of the Polish Civil Code);
    3. an Account is the part of the Website, protected by a password or by Google sign-in, where a User keeps their data.
  3. The Website does not accept orders yet. Sales will be governed by separate terms, which we will publish before sales start.

§ 3. Services

  1. We provide the following services on the Website free of charge:
    1. access to the Website's content, including product presentations, without an Account;
    2. product search;
    3. an Account (§ 5).
  2. A product presentation on the Website, including its price, is not an offer within the meaning of Article 66 of the Polish Civil Code but an invitation to conclude a contract (Article 71 of the Civil Code). Prices are in Polish zloty and include VAT.
  3. The contract for using the Website's content and search is concluded when you open the Website and ends when you leave it.

§ 4. Technical requirements

To use the Website you need:

  1. a device with Internet access and a current version of Chrome, Edge, Firefox or Safari with JavaScript and cookies enabled;
  2. to create and use an Account, an active email address, and to sign in with Google, a Google account.

§ 5. Account

  1. Creating an Account is voluntary and free. You can create one:
    1. with an email address: you enter your full name, email address and a password (at least 8 characters) and accept these Terms. We then send an activation link, valid for 24 hours, to that address. The Account is created when you open the link and enter your password again. If you do not activate the Account within that time, we delete the data from the form and no contract is concluded;
    2. with Google: you accept these Terms and sign in with your Google account. Google gives us your full name, verified email address and Google account identifier. The Account is created immediately.
  2. The contract for an Account is concluded when the Account is created, for an indefinite period.
  3. If an account with the given email address already exists, registering does not create a new Account; instead we send a notice about the attempt to that address. Signing in with Google using the same verified email address links the Google account to the existing Account.
  4. In your Account you can:
    1. change your full name;
    2. change your email address: the change takes effect when you open the link we send to the new address (valid for 24 hours), and we also notify the current address of the request;
    3. change your password, which signs out your other devices;
    4. set a new password through a link sent to the Account's email address (valid for 1 hour), also if you sign in only with Google;
    5. save addresses (first and last name, optionally a company name, phone number and address) and edit or delete them;
    6. sign out.
  5. You agree to:
    1. provide true information;
    2. keep your password safe and not share your Account with others;
    3. tell us without delay if you suspect someone else has accessed your Account.
  6. You must not supply unlawful content to the Website, including in form fields, or act in ways that disrupt the Website or endanger other Users' security (for example, attempts to break its security, guess passwords or submit forms automatically).
  7. To protect Accounts, we limit the number of attempts to sign in, register, set a password and change Account details. Once a limit is exceeded, further attempts are blocked for a short time.
  8. An Account may be created by an adult or by a person aged at least 13 with the consent of their legal guardian.

§ 6. Ending the contract

  1. You may end the Account contract at any time, without giving a reason and at no cost, by sending a request to delete your Account to contact@velmois.com from the Account's email address. We delete the Account without undue delay, within 14 days at the latest, and confirm by email. Deleting an Account deletes all data stored in it.
  2. A Consumer may also withdraw from the Account contract within 14 days of its conclusion, without giving a reason, by sending a statement to the address in section 1. Withdrawal has the same effect as deleting the Account and costs nothing.
  3. We may terminate the Account contract with 14 days' notice for a valid reason, namely:
    1. the Website ceasing to operate;
    2. a change in the law that prevents us from continuing the service;
    3. a User breaching these Terms despite being asked to stop.
  4. We may terminate the contract with immediate effect if a User supplies unlawful content or their actions endanger the security of the Website or other Users.
  5. We send notice of termination to the Account's email address, stating the reason.

§ 7. Particular risks of using the Website

Using services over the Internet carries risks we want you to be aware of:

  1. Impersonation (phishing). We never ask for your password by email, phone or message. Links in our emails lead only to velmois.com. Before entering your password, check the page address in your browser.
  2. Weak or reused passwords. Use a password you do not use anywhere else.
  3. Malware. Keep your operating system and browser up to date and use anti-virus software.
  4. Shared devices. On someone else's or a public device, sign out when you have finished.

Connections to the Website are encrypted (HTTPS), passwords are stored only as hashes (Argon2id), and we notify you by email of a password change or a request to change your email address.

§ 8. Cookies and personal data

  1. The Website uses only cookies that are strictly necessary for it to work. Their types, purpose and lifetime are described in the Privacy policy, "Cookies" section.
  2. The Provider is the controller of Users' personal data. How we process data and Users' rights are described in the Privacy policy.

§ 9. Complaints

  1. You can submit a complaint about the services provided on the Website by email to contact@velmois.com or in writing to the Provider's registered office.
  2. To help us deal with it, include your contact details, the Account's email address (if relevant) and a description of the problem.
  3. We reply within 14 days of receiving the complaint, by email or in writing, the same way it was submitted.
  4. A Consumer may use out-of-court complaint and redress procedures, in particular the help of a district (municipal) consumer ombudsman, consumer organisations and the regional inspector of the Trade Inspection. Information about them is published by the President of the Office of Competition and Consumer Protection at prawakonsumenta.uokik.gov.pl.
  5. We decide case by case whether to take part in out-of-court resolution of a dispute with a Consumer. If we reject a Consumer's complaint, our reply tells them what we decided.

§ 10. Website content

The texts, photographs, graphics and logo on the Website are protected by copyright. You may use them only for your own personal use, within the limits permitted by law.

§ 11. Availability and liability

  1. We aim to keep the Website available without interruption. We may temporarily restrict access because of maintenance, failures or security threats; where possible, we announce planned work on the Website.
  2. Nothing in these Terms excludes or limits the Provider's liability to Consumers where the law does not allow it to be excluded or limited.

§ 12. Changes to these Terms

  1. We may change these Terms for valid reasons, namely:
    1. a change in the law, or in its interpretation by courts or authorities, that affects these Terms;
    2. introducing new services or Website features, including the start of sales, or changing or withdrawing existing ones;
    3. a change in the Provider's details, including the Website's address or email address;
    4. the need to keep the Website secure or prevent abuse;
    5. the need to remove ambiguities or errors in these Terms.
  2. Each version of these Terms states the date from which it applies. We email Account holders about changes at least 14 days before they take effect. If you do not accept the changes, you may end the contract before that date under § 6(1).
  3. Changes do not affect rights acquired before they take effect.

§ 13. Final provisions

  1. These Terms are available free of charge at https://velmois.com/en/terms. You can print or save them using your browser. On request we send them by email.
  2. Matters not covered by these Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection of the mandatory provisions of the law of the country where they habitually reside.
  3. Disputes with Users who are not Consumers are resolved by the court having jurisdiction over the Provider's registered office.
  4. These Terms are available in Polish and English. In case of discrepancy the Polish version prevails, unless consumer protection law provides otherwise.
